How to Testify at a Public Service Commission (PSC) Hearing

Duke Energy Progress is proposing another residential rate increase. Raise your voice before they raise your rates! Attend a Public Service Commission hearing for an opportunity to learn more, ask questions, and share your feedback.

Before the Hearing

  • Sign In: Upon arrival, you must sign in at the registration table.
    • Provide your name and address.
    • Indicate “YES” if you want to testify.
    • Important: If you do not sign in with “YES,” you cannot testify.
  • Materials about the case may also be available at the sign-in table.

During the Hearing

  • Opening: The Chairperson introduces Commissioners, then turns the proceedings over to the Advisory Attorney.
  • Advisory Attorney explains:

    • Hearing procedures and purpose.
    • The law prohibits asking Commissioners direct questions.
    • Questions may be asked of the Company, Intervenors, or the Office of Regulatory Staff (ORS) only during breaks or after the hearing.
    • Each witness will have a 3-minute time limit.
    • Public witnesses may be questioned by attorneys for the Company, Intervenors, ORS, or the Commission itself.

When You Are Called to Testify

  • You will be sworn in or affirmed.
  • State your name and address for the record.
  • Deliver your statement clearly within the 3-minute time limit.
  • You may bring exhibits (documents, photos, etc.), but they can be challenged by attorneys.

Key Reminders

  • Protestants (members of the public) are not parties of record – meaning you do not have the right to cross-examine or appeal.
  • Speak from your own perspective and keep your remarks concise.
  • Respect the time limit so everyone has a chance to be heard.
