A durable power of attorney (DPOA) is one of the most important planning tools for clients who are looking to the future, whether as part of planning for possible incapacity or providing ongoing property management. The DPOA typically is part of the estate planning document package that attorneys prepare for their clients. Not only is a DPOA a valuable and useful tool, but it is also extremely powerful, and oftentimes the agent has extensive and significant powers. But does the agent understand how to serve as the power of attorney? We have all heard stories of the agent misusing the power of attorney, whether it is because of lack of knowledge or training, or a more nefarious reason.
The Professional Fiduciary Council of Florida is providing a “one of a kind” course offering. After completing the course, participants will fully understand the importance of serving as the agent under a power of attorney. The course instructors analyze and discuss the law’s requirements, best practices, case studies, and the power of attorney documents themselves. This course is designed for family members, law students, professional fiduciaries, guardians, attorneys, and CPAs.
The course, hosted by the Office of Professional Education at Stetson College of Law, is offered online twice per year—once in the fall semester and once in the spring semester—and runs for two weeks. The program includes pre-recorded lectures by Florida fiduciary experts, as well as self-graded assessments and activities. At the end of the second week, participants join a two-hour real-time Zoom session for discussion and questions.
There are two enrollment options available for this course. The Public Option, priced at $300, offers access to all course materials and live sessions, making it an excellent choice for individuals seeking foundational knowledge. The Certificate Option, available for $750, includes full access to course content and live sessions, along with a post-course final examination. Participants who successfully pass the final examination will receive a Certificate of Completion and a digital badge. Additionally, CLE, CEU, and Paralegal credits may be available with the Certificate Option; however, credits are not guaranteed and may vary depending on jurisdiction and individual circumstances.
