AARP GENERAL RELEASE
For good and valuable consideration, receipt of which is hereby acknowledged, I hereby grant to AARP and its licensees, affiliates, assigns, agents, employees, and vendors the absolute, irrevocable right and permission with respect to any recording, transcript, picture, film, video, telecast, live stream, podcast and/or filmstrip (“the Production”) made by or produced for AARP to use, record, reproduce, distribute, edit, reuse, transmit, publish and republish my name, photograph, voice, sounds, statements, image, likeness, acts, poses, plays, musical performances, artwork and appearances in any manner, in whole or in part, individually or in conjunction with other materials, in any medium, now known or hereafter developed (including, without limitation, television, Internet streaming and downloads), and for any purpose whatsoever throughout the world, an unlimited number of times in perpetuity, including (without limitation) illustration, promotion and advertising, including the right to edit or modify and/or simulate my voice, acts, appearances, to such extent as may be desired by AARP. I also hereby grant to AARP and its licensees, affiliates, assigns, agents, employees, and vendors the absolute, irrevocable right and permission to use my prepared and extemporaneous remarks, materials and a transcript of my statements (“Materials”) including the right to edit or modify the Materials.
I understand that AARP either owns the copyright and all other rights in and to the Production or has an irrevocable, worldwide, royalty free right to use the Production and Materials in any manner. I also understand that I will not have any right of approval or receive any compensation as a result of any use or re-use of the Production and/or Materials. I hereby waive any rights of privacy or publicity that I may have with respect to the Production and Materials and any use or re-use of the Production and Materials. I acknowledge that AARP will rely on the terms and conditions and the permissions granted in this release potentially, at substantial cost to AARP and hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the terms and conditions and permissions granted herein. I represent that any statements made by me during the Production and/or in the Materials are true, to the best of my knowledge. I also represent that AARP’s use, recording, reproducing, distributing, editing, reusing, transmitting, publishing and republishing my name, photograph, voice, sounds, image, likeness, acts, poses, plays, musical performance, musical recordings, artwork and appearances in the Production and in the Materials will not violate or infringe upon the rights of any third party.
I agree to take commercially reasonable measures to protect information obtained from AARP that is either marked “confidential” or is of such a nature that a reasonable person would have reason to believe it is confidential. I shall not use, store, process, rent, sell, lease, distribute, or otherwise knowingly make available to any third party any information obtained from AARP about AARP, AARP members and/or event attendees, including personal information such as email addresses, names, phone numbers, etc., or any AARP activity, unless (i) prior written authorization has been obtained from AARP; or (ii) I am required to release information by valid subpoena or court order. This section shall survive the expiration or termination of this Agreement.
I release and discharge AARP and its affiliated companies and its licensees, and their respective agents, advertisers, contractors, officers, vendors and employees, from any and all claims and demands arising out of or in connection with the use of the Production and/or Materials, including, without limitation any and all claims based on rights of publicity, privacy, or for defamation.
